10.1 Offers made by voestalpine as well as the fulfillment of existing contractual delivery obligations are subject to the express proviso that their execution neither conflicts with applicable trade/export control regulations nor becomes economically unreasonable to voestalpine for reasons, e.g. antidumping/ countervailing duties, beyond the control of voestalpine. Should any such anti-dumping/countervailing duties become applicable, making it economically unreasonable for voestalpine to adhere to its offers and/or delivery obligations, voestalpine shall be released from its (pre-) contractual obligations, shall not be in breach of its (pre-)contractual obligations and shall be indemnified and held harmless by the Buyer with respect to all costs/damages incurred in this regard.
